Hi ed. What does this overturned ban at Milan mean now for ffp? It seems strange UEFA cannot make this stick. And sets a worrying precedent imo.

{Ed001's Note - it just means that CAS felt the punishment was disproportionate, it does not mean FFP is dead, just that they have to rethink the punishments. Personally I think CAS has made a major mistake and that bans from the competition are the right punishment, rather than the standard fines, which make no sense.}

Very entertaining as usual ed, much appreciated mate. Totally agree that Milan escaping a real punishment is a mistake. They’ve set a precedence going forward that will likely bring an end to ffp. Or at least effective ffp. The alternative to European bans is a steep fine and well if your punishing a club for spending too much, they’ll have few issues with anything beyond that. Cheers.

A fine is not a strong enough deterrent when it comes to FFP, if the clubs have got the money to breach FFP in the first place, they are not going to be bothered about a measly fine, whereas being banned from the UCL or EL would deter a lot of clubs I think!

{Ed002's Note - Numerous clubs have been banned from competition at one time or other so it is not just fines imposed, there are many other sanctions. If you go back a couple of years:
Clubs banned from competition: Malaga, Gyori ETO, Parma, FK Ekranas, CFR 1907 Cluj, FC Astra Giurgiu, Bursaspor, Galatasaray, Red Star Belgrade, Spartak Moscow
Clubs sanctioned and fined: Manchester City, PSG, Zenit, Galatasaray, Monaco
Clubs fined: Levski Sofia, Hapoel Tel-Aviv, Hull, Panathinaikos, Ruch Chorzow, Dinamo Moscow, Roma, Inter Milan and Trabzonspor
Clubs currently warned and subject to on-going monitoring: Zenit, Rubin Kazan, Anzhi Makhachkala, Levski Sofia
Clubs currently subject to on-going monitoring: Besiktas (who were previously banned and have also paid a voluntary fine), Lyon, Liverpool (who were previously warned), Sparta Prague (who were previously warned), Wolfsburg
Clubs who settled by paying a voluntary fine to curtail on-going investigation: Sporting Lisbon, Rostov, Besiktas (who were previously warned), Krasnodar (who were previously warned), CSKA Sofia, Kardemir Karabukspor and Lokomotiv Moscow (who were previously warned)}

I understand that ed002, but won’t the CAS’s decision to overrule AC Milan’s bam have a knock on effect? Every time a team gets banned now, they will appeal and surely the CAS cannot overturn the ban of one team and then uphold the ban of another? In my eyes, the decision of the CAS has thrown the whole FFP rules up in the air!

{Ed002's Note - Just about every team that has been banned has appealed to CAS when they have been banned. Fenerbahce, Bursapor, Partizan Belgrade and others have made successful appeals in the past. CAS is there as a final resort to arbitrate how approriate punishments are - PSG and Manchester City had CAS reduce €60M fines reduced to €20M. I could argue that many people new the FIFA ban was coming for AC Milan two weeks before it happened. I could argue that the punishment handed out by UEFA for the infraction was unreasonable given the offence. CAS has not thrown any rules up in the air, you are over-reacting to what is simply business as usual for an appeal process.

Well I suppose we will have to agree to disagree, Milan got a new owner who spent nearly £160 million, failed to break even and not expect serious repercussions! I think a one year ban was a just punishment and I think it would be just for any team who did that or similar, including Liverpool.

{Ed002's Note - I think perhaps you have read a headline without fully understanding the situation, nor probably FFP. If you are going to make very vague broad statements and raise points about money in the wrong currencies, it would be a great deal better to equip yourself with the full facts and an understanding the subject matter.

Is there a threshhold where you would ban Liverpool - they have a recent history of significant loss making?}
